1. Service Overview

These terms and conditions govern the provision of web application development services by Pammas. By engaging our development services, you agree to be bound by these terms in addition to our general Terms of Service.

2. Services Offered

2.1 Development Services

We provide the following web development services:

  • Custom web application development
  • Website design and development
  • E-commerce solutions
  • API development and integration
  • Database design and implementation
  • Maintenance and support services

2.2 Technology Stack

We specialize in modern web technologies including but not limited to: React, Next.js, Node.js, TypeScript, and various database solutions.

3. Project Scope and Requirements

3.1 Project Definition

Each project begins with a detailed scope definition that includes:

  • Functional requirements and specifications
  • Technical requirements and constraints
  • Timeline and milestone schedule
  • Budget and payment terms
  • Deliverables and acceptance criteria

3.2 Scope Changes

Changes to the agreed project scope must be documented and approved in writing. Scope changes may affect timeline and budget, which will be communicated before implementation.

3.3 Client Responsibilities

Clients are responsible for:

  • Providing clear and complete requirements
  • Timely feedback and approvals
  • Providing necessary content, images, and data
  • Access to required third-party services or APIs

4. Development Process

4.1 Project Phases

Our development process typically includes:

  • Discovery: Requirements gathering and planning
  • Design: UI/UX design and prototyping
  • Development: Coding and implementation
  • Testing: Quality assurance and bug fixes
  • Deployment: Launch and go-live support

4.2 Communication and Updates

Regular progress updates will be provided through agreed communication channels. Clients will have access to development environments for review and feedback.

5. Payment Terms

5.1 Project Pricing

Project pricing may be structured as:

  • Fixed Price: Total project cost agreed upfront
  • Time & Materials: Hourly rate for actual work performed
  • Milestone-based: Payments tied to project milestones

5.2 Payment Schedule

Standard payment terms:

  • 50% deposit required to begin work
  • Progress payments at agreed milestones
  • Final payment due upon project completion
  • Net 15 days payment terms unless otherwise agreed

5.3 Additional Costs

Third-party services, licenses, hosting, and domain costs are separate unless explicitly included in the project quote.

6. Intellectual Property Rights

6.1 Client Ownership

Upon full payment, clients own the custom code developed specifically for their project, excluding any pre-existing frameworks, libraries, or third-party components.

6.2 Our Rights

We retain rights to:

  • General methodologies and techniques
  • Reusable code components and frameworks
  • Knowledge and experience gained
  • Use project as portfolio example (with client consent)

6.3 Third-party Components

Projects may include open-source libraries and third-party services subject to their respective licenses and terms.

7. Testing and Quality Assurance

7.1 Testing Process

Our quality assurance includes:

  • Functional testing of all features
  • Cross-browser compatibility testing
  • Responsive design testing
  • Performance optimization
  • Security best practices implementation

7.2 Bug Fixes

Bugs identified during the development phase will be fixed at no additional cost. Post-launch bug fixes are covered under our warranty period.

8. Delivery and Acceptance

8.1 Project Delivery

Project delivery includes:

  • Complete source code and documentation
  • Deployment to agreed hosting environment
  • Basic user training or documentation
  • Handover of administrative access

8.2 Acceptance Criteria

Projects are considered complete when all agreed deliverables meet the specified requirements and pass acceptance testing.

9. Warranty and Support

9.1 Warranty Period

We provide a 30-day warranty period from project delivery for:

  • Bug fixes for issues not caused by client modifications
  • Minor adjustments to meet original specifications
  • Technical support for deployment issues

9.2 Ongoing Support

Post-warranty support, maintenance, and feature enhancements are available under separate service agreements.

10. Hosting and Maintenance

10.1 Hosting Services

We can recommend hosting solutions but are not responsible for hosting performance, uptime, or security unless explicitly contracted.

10.2 Maintenance Services

Optional maintenance services include:

  • Regular security updates
  • Performance monitoring
  • Backup management
  • Content updates
  • Feature enhancements

11. Confidentiality

11.1 Non-Disclosure

We maintain strict confidentiality regarding client business information, proprietary data, and project details. NDAs can be signed upon request.

11.2 Data Security

We implement appropriate security measures to protect client data during development and follow industry best practices for secure coding.

12. Limitation of Liability

12.1 Service Limitations

Our liability is limited to the total amount paid for the specific project. We are not liable for indirect damages, lost profits, or business interruption.

12.2 Third-party Services

We are not responsible for the performance, availability, or security of third-party services integrated into client projects.

13. Termination

13.1 Project Termination

Either party may terminate a project with written notice. Client will pay for work completed up to the termination date.

13.2 Deliverables Upon Termination

Upon termination and full payment of outstanding invoices, client will receive all work completed to that point.
